These Terms of Use ("Terms") establish the legally binding framework that governs your access to and use of the mobile application Anno 1800 (the "Game"), together with its website, companion services, online systems, downloadable content, and any associated features, updates, or promotional activities (collectively, the "Services"). These Terms form an agreement between you (the "User") and the development team ("we," "us," or "our"). By installing, accessing, or otherwise engaging with the Services, you acknowledge that you have read, understood, and consented to be bound by these Terms. If you do not accept these provisions, you must immediately discontinue use of the Services.
1. Eligibility and Account Registration
- 1.1 Age Requirement: The Services are open exclusively to individuals aged 13 years or older. Users under the age of 18 may participate solely with documented parental or guardian authorization. By continuing to use the Services, you represent and warrant that you satisfy these eligibility requirements.
- 1.2 Registration Data: All information provided during account creation must be truthful, current, and complete. Submitting misleading or false details, impersonating other individuals, or otherwise providing fraudulent data is strictly prohibited and may result in termination of access.
- 1.3 Account Responsibility: You bear sole responsibility for safeguarding your login credentials. Any activity occurring under your account will be deemed to have been performed by you, and you accept liability for such actions.
- 1.4 Multiple Accounts: Unless expressly authorized, maintaining multiple accounts for personal gain, manipulation of game systems, or competitive imbalance is forbidden.
2. Code of Conduct
- 2.1 Fair Play: You agree to uphold integrity and fair competition. The use of unauthorized software, scripts, bots, exploits, reverse engineering, or any manipulation designed to alter the natural functioning of the Game is strictly prohibited.
- 2.2 Respectful Interaction: Users may not engage in harassment, abusive language, discriminatory speech, spamming, or disruptive behavior. Impersonation of staff or other participants is likewise forbidden.
- 2.3 Exploit Reporting: If you encounter bugs, vulnerabilities, or exploitable mechanics, you are obligated to report them promptly. Exploiting such flaws for personal gain constitutes a violation of these Terms.
- 2.4 Community Spaces: Forums, chats, and multiplayer functions are to be used responsibly. Offensive, harmful, or illegal content will not be tolerated.
3. Virtual Goods, Contributions & Transactions
- 3.1 Contributions: The Game may provide opportunities for voluntary contributions that support ongoing development. Such contributions are not mandatory and shall not be considered charitable donations unless expressly stated.
- 3.2 Virtual Assets: All in-game content such as digital currency, unlockable features, exclusive cosmetics, or access passes (including but not limited to the Rider’s Elite Pass) represent limited rights of use. They have no intrinsic monetary value outside the Game and are not redeemable for cash.
- 3.3 Transactions: All purchases conducted within the Services are final and non-transferable, except where platform policies or applicable laws mandate a refund. Prices may vary depending on jurisdiction and platform provider.
- 3.4 Non-Transferability: Virtual items are permanently linked to the purchasing account. They cannot be gifted, traded, resold, or converted into real-world property.
4. Content Rights & Intellectual Property
- 4.1 Proprietary Rights: All intellectual property associated with Anno 1800 — including graphics, characters, environments, music, story elements, software code, trademarks, and logos — remains the exclusive property of the creators and their licensed partners.
- 4.2 Restrictions: You are expressly forbidden from copying, distributing, modifying, reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code or design of any part of the Services.
- 4.3 Player Submissions: Should you provide ideas, suggestions, feedback, or creative material, you grant us an irrevocable, perpetual, worldwide, royalty-free license to utilize, adapt, and implement such content for any purpose, including commercial use, without obligation of compensation.
5. Suspension, Termination & Enforcement
- 5.1 Violations: We reserve the right to suspend, restrict, or permanently terminate accounts that breach these Terms, engage in fraudulent or harmful conduct, or threaten the integrity of the community.
- 5.2 Enforcement Actions: Sanctions may include temporary suspensions, revocation of in-game assets, leaderboard resets, permanent bans, or referral to legal authorities where warranted.
- 5.3 Appeal Process: Users subject to sanctions may request a review of their case through official support channels. However, final decisions remain at our discretion.
6. Disclaimers and Limitation of Liability
- 6.1 Service Basis: The Services are provided "as is" and "as available." We make no guarantees regarding uninterrupted access, flawless performance, or compatibility with all devices or operating systems.
- 6.2 Liability Limitations: To the fullest extent permitted by law, we disclaim responsibility for direct, indirect, incidental, consequential, or punitive damages, including but not limited to data corruption, progress loss, or failure of virtual goods.
- 6.3 Third-Party Services: We assume no liability for disruptions, damages, or disputes arising from third-party platforms, payment providers, or external content accessed through the Services.
7. Updates, Modifications & Availability
- 7.1 Terms Amendments: These Terms may be updated periodically. Significant changes will be communicated via in-app notices or official channels. Continued use after modifications constitutes acceptance.
- 7.2 Game Updates: We may add, modify, or discontinue content and features at any time. This may include phasing out outdated devices, mechanics, or game modes.
- 7.3 Service Availability: Downtime may occur for maintenance, updates, or unforeseen circumstances. We are not obligated to maintain continuous access at all times.
8. Governing Law and Dispute Resolution
- 8.1 Applicable Law: These Terms shall be governed by the laws of the jurisdiction where our development team operates, except where mandatory consumer protection laws of your region provide otherwise.
- 8.2 Informal Resolution: Parties agree to attempt informal negotiations prior to initiating formal dispute processes. Only if unresolved may disputes proceed to arbitration or small claims court, depending on applicable law.
- 8.3 Binding Arbitration: Where permitted by law, disputes shall be resolved through binding arbitration conducted by a recognized arbitration body. Users waive the right to class actions or jury trials, unless restricted by jurisdictional law.
